American Approaches to Teaching the Constitution

As we announced in a previous article, yesterday, 19th of January, took place at the American Corner within the National Library of Romania, from 3 PM, the workshop „American Approaches to Teaching the Constitution”, organized by the United States of America Embassy and moderated by Ms. Marisa MacIsaac.

The purpose of the workshop was represented by the assimilation of the practical way of teaching the Constitutional law in the US since elementary school, thus it began with the visualization of an educational clip about the Preamble to the US Constitution. Make no mistake… in elementary school begins the formal education of the young students regarding the fundamental rights, liberties and duties, but the nonformal education is offered to them since early childhood, through songs, games, stories and such other methods. In the 3rd grade, the american students go on a trip to Washington, D.C., where they visit, for example, the Lincoln Memorial, the US Capitol or the Washington Monument. Thus, they benefit of a precious lesson about the past of the nation, as well as the role and the functioning of the central authorities, by the means of a pleasant experience.

The distribution of some didactic materials – elaborated by a team of specialists within the US Embassy under the coordination of Ms. Marisa MacIsaac – about the freedom of expression (article 30 of the Romanian Constitution) took place right after. After reading the article, the participants to the workshop offered examples of thoughts, opinions, beliefs and creations covered by this freedom, thus allowing the differences between each category to follow naturally. After the comprehension of the freedom of expression’s content, we proceeded to analyze the 6th paragraph enumerating the limitations of the aforementioned freedom, for raising awareness of the rule’s relativism: „My freedom ends where another one’s begins” (John Stuart Mill).

If these discussions were the theoretical part, the practical one consisted of the article 30 reference to the content of some comics within those materials, to determine whether the limits of the freedom of expression were breached. This task was initially accomplished at a group level, a reporter presenting afterwards to the other participants the group’s conclusions. The teaching method is similar to the one used in the US. It is based on the numerous researches in the field of educational sciences, having a profoundly interactive nature and aiming the assimilation of the information by the students in a logical manner, through their own conclusions and deductions, within working groups and under the guidance of a moderator: „To follow the process and come to a conclusion are more important than memorizing the information”.

On this occasion, we salute the excellent action of the US Embassy and we hope that we shall fulfill the request for elementary legal education through the „Be independent through law!” Guide.

După cum am anunțat într-un articol precedent, ieri, 19 ianuarie, a avut loc la American Corner din cadrul Bibliotecii Naționale a României, începând cu ora 15, workshopul „American Approaches to Teaching the Constitution”, organizat de Ambasada Statelor Unite ale Americii și moderat de doamna Marisa MacIsaac.

Întrucât scopul workshopului a fost reprezentat de asimilarea modului practic în care este predat Dreptul constituțional în SUA încă din școala elementară, acesta a debutat prin vizualizarea unui videoclip educativ despre Preambulul Constituției SUA. A nu se înțelege greșit… în școala elementară începe educația formală a elevilor cu privire la drepturile, libertățile și îndatoririle fundamentale, însă educația nonformală este oferită acestora încă din fragedă copilărie, prin cântece, jocuri, povești și alte asemenea metode. În clasa a 3-a, elevii americani merg în excursie la Washington, D.C., unde vizitează, spre exemplu, Monumentul Comemorativ al lui Lincoln, Capitoliul Statelor Unite ori Monumentul Washington. Astfel, ei beneficiază de o lecție prețioasă atât despre trecutul națiunii, cât și despre rolul și funcționarea autorităților centrale, prin intermediul unei experiențe plăcute.

A urmat distribuirea unor materiale didactice – elaborate de către o echipă de specialiști din cadrul Ambasadei SUA de la București sub coordonarea doamnei Marisa MacIsaac – legate de libertatea de exprimare (art. 30 din Constituția României). După lecturarea articolului de către participanții la workshop, s-au oferit exemple de gânduri, opinii, credințe și creații ce cad sub incidența acestei libertăți, astfel încât diferențele dintre fiecare categorie au decurs în mod natural. Ulterior înțelegerii conținutului libertății de exprimare, s-a procedat la analiza alineatului (6) enumerând limitări ale libertății anterior menționate, în vederea conștientizării relativismului normei: „Libertatea mea se termină acolo unde începe libertatea altuia” (John Stuart Mill).

Dacă aceste discuții au reprezentat partea teoretică, partea practică a constat în raportarea art. 30 la conținutul unor caricaturi din cuprinsul acelor materiale, pentru a se determina dacă au fost sau nu depășite limitele libertății de exprimare. Această sarcină a fost îndeplinită inițial la nivel de grup, un raportor prezentând ulterior tuturor participanților concluziile grupului. Modalitatea de predare este similară celei utilizate și în SUA. Aceasta se fundamentează pe numeroasele cercetări în domeniul științelor educației, având un profund caracter interactiv și propunându-și asimilarea informațiilor de către elevi într-o manieră logică, prin propriile concluzii și deducții, în cadrul unor grupuri de lucru și sub îndrumarea unui moderator: „Să urmați procesul și să ajungeți la o concluzie sunt mai importante decât memorarea informațiilor”.

Salutăm, cu acest prilej, excelentul demers al Ambasadei SUA, și sperăm că vom împlini dezideratul unei educații juridice elementare prin intermediul Ghidului „Fii independent prin drept!”.
